GENERAL TERMS AND CONDITIONS OF SALE (GTC)

General

Please read these General Terms and Conditions of Sale (the “GTC”) carefully before placing an order on the website www.jerem.com. Access to and use of the website as well as any order placed are subject to acceptance of these GTC.

These GTC apply, without restriction or reservation, to all sales concluded by TOO FASHION SAS with non‑professional buyers on the website www.jerem.com. TOO FASHION SAS operates the JEREM and TOO FASHION brands and sells men’s ready‑to‑wear products.

The Products offered for sale on the site are:

Suits, Jackets, Trousers, Parkas and Blousons, Shirts, Sweaters, Coats, Leather goods, Jeans and 5‑pocket trousers, Ties, Socks, Boxer shorts, Belts, T‑shirts, Polo shirts, Bracelets, Braces, Gloves, Shoes, Bow ties.

The main characteristics of the Products — including specifications, fabric/material and patterns, size or colour indications — are presented on www.jerem.com, which the Client must consult before ordering.

The choice and purchase of a Product are the sole responsibility of the Client.

Product offers are valid while stocks last, as specified at the time the order is placed.

These GTC are accessible at any time on www.jerem.com and shall prevail over any other document.

The Client declares having read these GTC and accepted them by ticking the box provided for this purpose before initiating the online ordering procedure on www.jerem.com.

Unless proven otherwise, the data recorded in TOO FASHION’s IT system constitute proof of all transactions concluded with the Client.

The Products presented on www.jerem.com are offered for sale in the following territories:

France, Germany, Belgium, the Netherlands, Luxembourg, Italy, Spain, Austria, Ireland, Portugal, and other EU countries.

ARTICLE 2 – PRICES & VALIDITY CONDITIONS

Product prices are displayed in euros, all taxes included (VAT incl.), excluding delivery charges. The applicable prices are those in force at the time the order is confirmed.

Orders are accepted in the following countries: France, Germany, Belgium, the Netherlands, Luxembourg, Italy, Spain, Austria, Ireland, Portugal, and other EU countries.

Prices on the JEREM Online Store (www.jerem.com) are indicated per item and reference, VAT included. Prices always exclude delivery charges; the Client is informed of the delivery charges during the ordering process.

Products are invoiced at the rates in force when the Client confirms the order. The price indicated at the time of the order and in the confirmation email from the JEREM Online Store is the final price. The JEREM Online Store reserves the right to modify prices at any time.

When ordering, Clients are advised to ensure that the Product price they refer to matches the current price on the up‑to‑date page of www.jerem.com and not a cached page accessed via an Internet search.

The data provided by the Client and recorded by www.jerem.com when placing the order constitute proof of the transactions between the JEREM Online Store and the Client. After the order is validated by the Client, the JEREM Online Store will send a confirmation email to acknowledge that the order has been recorded.

The price of the Products purchased is payable in full on the day the order is placed. The JEREM Online Store is not obliged to deliver the Products ordered by the Client if the price (including delivery charges) has not been paid in full in advance. Title to the Products transfers to the Client only after full payment of the price. The transfer of risk of loss and damage to the Products takes place upon delivery and receipt by the Client.

Delivery charges are indicated on www.jerem.com and are expressed as all‑inclusive amounts. These charges are payable by the Client and are invoiced in addition to the sale price of the Products. The Client will be informed, before the final registration of the order, of the delivery charges applicable to the order, and payment will be requested for the total purchase amount.

Products offered for sale on www.jerem.com are available while stocks last. If an item ordered becomes unavailable after the order has been placed, the JEREM Customer Service will inform the Client by email or letter. The order will be automatically cancelled and the Client immediately refunded.

ARTICLE 3 – ORDERS

It is the Client’s responsibility to select on www.jerem.com the Products they wish to order, according to the following process:

1/ Browsing and Selecting Products
The Client may browse the online catalogue and select items of their choice. Before adding a product to the cart, the Client must choose from the available options (size, colour, or any other option). A detailed product sheet is available for each item to assist with selection.

2/ Cart Review
Once Products are added to the cart, the Client can view a summary of the selection. Quantities and options may be modified; items may be removed; purchases may continue before proceeding to the next step.

3/ Sign‑in or Account Creation
If the Client already has an account, they can log in with their credentials. New clients must enter their personal information and create an account or check out as a guest. The Client must accept the GTC before finalising the purchase.

4/ Entering Delivery Information
The Client enters the delivery address and any specific instructions.

5/ Choosing the Delivery Method
Different delivery options are offered depending on the geographic area and desired timeframes. Delivery charges are specified at this stage.

6/ Selecting the Payment Method
Accepted payment methods: bank card or PayPal.

7/ Order Review and Confirmation
Before final validation, an order summary is presented with details of the items (including selected options), the total price, any charges, and the delivery address.

8/ Secure Payment
Payment is made via a secure platform. A transaction confirmation is displayed after payment validation.

9/ Order Confirmation
A confirmation email is sent to the Client summarising the order details, including selected options, the tracking number (if applicable) and Customer Service contact details.

10/ Shipping and Tracking
Once the order is shipped, the Client receives a notification with a tracking link for real‑time tracking.

11/ Receipt and Right of Withdrawal
Upon receipt, the Client must check the condition of the parcel and report any anomaly to Customer Service. The Client has a statutory period in which to exercise the right of withdrawal, in accordance with applicable law.

Product offers are valid as long as they are visible on the site and while stocks last.

The sale will be considered final only after full payment. It is the Client’s responsibility to check the accuracy of the order and to report any error immediately.

Any order placed on www.jerem.com constitutes a distance contract between the Client and the Seller.

The Seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute regarding payment of a previous order.

The Client may track the progress of the order on the site.

ARTICLE 4 – SECURE PAYMENT

Payment is due immediately upon ordering by bank card (Visa, Mastercard), PayPal, or other methods indicated on the site.

The charge is made when the payment is validated. The site uses a secure payment system via Worldline, ensuring the protection of banking data.

Pursuant to Article L.132‑2 of the French Monetary and Financial Code, a commitment to pay given by means of a payment card is irrevocable. By providing the bank card number and the aforementioned information, the Client authorises TOO FASHION to debit the credit card for the total amount including VAT of the order (including delivery charges). The Client’s bank card is debited when the order payment is validated. For this purpose, the Client confirms the name of the cardholder to be debited, then provides, in a secure environment, the sixteen‑digit card number and the expiry date appearing on the front of the card, as well as, where applicable, the visual security code (CVV/CVC) on the back of the card.

TOO FASHION reserves the right to verify the personal data provided by the Client and to take any measures it deems necessary (request for supporting documents and/or order cancellation) to verify that the person whose bank account is debited is indeed the one who placed the order, and thus to prevent any fraudulent use of bank card numbers on its Online Store.

The Products ordered remain the property of TOO FASHION until the invoice has been paid in full.

Worldline alone, via its secure space, has knowledge of the Client’s banking information. This information does not transit in any way through the JEREM Online Store (www.jerem.com).

ARTICLE 5 – SHIPPING & DELIVERY

Orders are shipped within 2 to 5 business days via Colissimo. Delivery costs and timeframes are indicated during checkout.

The Client must check the condition of the parcel upon receipt and notify any anomaly to the carrier on the day of delivery.

At checkout, the Client is shown the available delivery methods, locations and rates. The Client may choose home delivery (or to an office, a third party, or a holiday location) by Colissimo, or to a Mondial Relay pickup point. In all cases, the delivery location must be in metropolitan France (including Corsica), Germany, Belgium, the Netherlands, Luxembourg, Italy, Spain, Austria, Portugal, Bulgaria, Cyprus, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Malta, Poland, Czech Republic, Romania, Slovakia, Slovenia, Sweden.

Orders are delivered by La Poste/Colissimo or to a Mondial Relay pickup point, to the delivery address entered by the Client, within 2 to 5 business days.

When a parcel leaves TOO FASHION’s warehouses for delivery to the address indicated by the Client, the Client receives by email a shipping confirmation indicating the parcel tracking number.

For Colissimo delivery, the parcel is delivered against signature. If the recipient is absent, a delivery notice is left.

With the delivery notice, the Client may collect the parcel from the Post Office upon presentation of ID within 15 days from the date of the notice. After this period, the parcel will be returned to TOO FASHION. The JEREM Customer Service will then contact the Client regarding a possible reshipment.

If within 5 business days after shipment the Client has no news of the order, they must contact the nearest Post Office to the delivery location or Mondial Relay. If neither the Post Office nor the tracking systems on the Colissimo or Mondial Relay websites show any trace of the parcel, the Client must contact TOO FASHION via JEREM Customer Service, which will open an inquiry with La Poste or Mondial Relay. TOO FASHION is then bound by the carriers’ response times:

  • If the parcel is found, it will be sent to the Client: the reception procedure then follows its normal course (delivery or delivery notice).

  • If the parcel is declared lost, TOO FASHION will inform the Client and immediately initiate a refund (products and shipping costs).

The following are considered force majeure events releasing TOO FASHION from its delivery obligation: war, riot, fire, flood, strikes, accidents, impossibility of being supplied, etc.

It is the Client’s responsibility to check shipments upon arrival and to refuse the parcel if it appears to have been opened or shows obvious signs of damage. If the Client accepts the parcel and later finds the goods have been damaged, they must send a claim by registered letter with acknowledgement of receipt to TOO FASHION within 3 working days, excluding public holidays, following delivery of the products.

As this is a distance sale, no claim of any kind can be processed in store.

In accordance with the French Consumer Code, TOO FASHION grants the Client a right of withdrawal. This period is fourteen (14) days from delivery to reconsider the purchase decision and return the item(s). (See “RETURNS” tab.)

ARTICLE 6 – RIGHT OF WITHDRAWAL & RETURNS POLICY

6.1 Exercising the right of withdrawal

In accordance with Article L.221‑18 of the French Consumer Code, the Client has 14 days from receipt to exercise the right of withdrawal, without having to give reasons or pay penalties. If the period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

Upon receipt of the letter, TOO FASHION will send a prepaid return label by email.

TOO FASHION is obliged to refund the consumer all sums paid, including delivery costs, without undue delay and at the latest within fourteen (14) days from the date on which the company receives the returned items. The order must be returned in full in the original packaging, with the original tags not removed, complete (including accessories), new, unworn, unwashed and accompanied by the completed withdrawal form.

6.2 Returns policy

Products must be returned, together with the Return Form, in their original packaging, unworn, with original tags not removed, unwashed and complete (including accessories), within 30 days of the order confirmation. Return shipping costs are borne by the Client, except in the event of an error on our part.

The Client has 30 days from the order confirmation to request a return. Return costs are borne by the Client, except in the event of our error. In case of our error, a prepaid return label will be sent by email to the Client upon notification of the error within 14 days following receipt of the order. Products must be returned in their original packaging, unworn, unwashed and complete (including accessories).

In all other cases, return shipping costs are payable by the Client.

In the event of returning one or more ordered products, the JEREM Online Store recommends that Clients use a trackable shipping option to avoid any inconvenience in the event of loss or theft during return transport.

Items must be returned in their original packaging, complete, new, unworn, unwashed and accompanied by the Return Form. The Return Form can be downloaded from the “My Account” area. Items returned without a Return Form and/or that do not meet the listed conditions, or that are damaged, deteriorated or soiled by the Client, will not be refunded.

In the event of a partial return or no return of products that were part of a global promotional offer including one or more gifts, the gifts granted by the JEREM Online Store relating to the purchase must be returned to the JEREM Online Store. If the Client keeps the gift(s) from the global promotional offer, their initial price will be deducted from the refund.

In the event of a partial return of Products purchased under a global promotional offer including discounts, the Products kept by the Client will be invoiced at their initial price, without promotion.

If Products are returned after the above deadline, the Client will not be refunded and will be informed that the Products will be kept at the warehouse for 1 month. At the Client’s request and expense, the Products can also be reshipped.

Note: Products purchased on the JEREM Online Store cannot be exchanged by post, nor can a store credit be issued.

6.3 Refunds

Refunds are made within 14 days from receipt of the returned Products.

The Client has 30 days to request a return from the date of order confirmation.

ARTICLE 7 – STATUTORY WARRANTY & LIABILITY

Products benefit from the legal warranty of conformity (Articles L.217‑3 to L.217‑20 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).

The company cannot be held liable in cases of force majeure or for indirect or consequential damages resulting from the use of the Products.

Items sold on www.jerem.com are subject to the warranty conditions provided by law. In the event of non‑conformity of an item, the Client may, at their choice and after returning the product under the conditions in Article 6.2, be refunded for the item ordered within 14 days following receipt of the return. These provisions do not deprive the Client of the right of withdrawal provided for in Article 6.1.

TOO FASHION shall not be liable:

  • In the event of a breach of contractual obligations due to a fortuitous event or force majeure;

  • In the event of non‑material differences between the photos, texts and illustrations of items on the JEREM Online Store and the items delivered.

ARTICLE 8 – PERSONAL DATA PROTECTION

Data collected are processed in compliance with the GDPR and our Privacy Policy.

The Client has rights of access, rectification and deletion by contacting contact@jerem.com.

TOO FASHION manages an electronic file containing certain personal data relating to its clients. When a new Client places an order on www.jerem.com, this database is enriched with information about them, which will then make it possible to better respond to their expectations and facilitate support services provided by JEREM Customer Service.

When creating or consulting their online accounts, Clients agree to receive offers from TOO FASHION.

If the Client consents to communicate personal data, they have an individual right of access, withdrawal and rectification provided by law and may, in this respect, have information concerning them deleted if it is no longer relevant, by sending a request by email to: contact@jerem.com.

By registering on our site, the Client agrees to receive our offers and newsletters. At any time, they may request to be removed from the distribution list by writing to contact@jerem.com or by calling 01 44 52 19 06.

The website www.jerem.com uses cookies. A cookie is a computer file stored on the Client’s hard drive to improve and customise the service provided by TOO FASHION. The Client may refuse cookies by configuring their Internet browser.

ARTICLE 9 – INTELLECTUAL PROPERTY

All content on the site (texts, images, logos, etc.) is the exclusive property of TOO FASHION. Any reproduction is strictly prohibited without prior authorisation.

ARTICLE 10 – DISPUTES & MEDIATION

In the event of a dispute, the Client may contact Customer Service. In accordance with Articles L.616‑1 and R.616‑1 of the French Consumer Code, any unresolved dispute may be submitted to a consumer mediator.
